Does international human rights law apply universally, regardless of migration status? How and why does the human rights system distinguish between different categories of migrants (refugees, asylum seekers, stateless persons, ‘irregular’ migrants, migrant workers), and are these distinctions normatively consistent? Under what circumstances does human rights law serve as an effective check on states’ authority to enact and enforce border controls? Does human rights doctrine impose extraterritorial obligations on states vis-à-vis non-citizens? Is international refugee law best understood as a subset of international human rights law, or as its own distinct project, and are there tensions between the two? Can private corporations ever be held liable under international law for their treatment of migrants at home or abroad? What might the answers to these questions tell us about the emancipatory potential, or lack thereof, of human rights protection today? This course will explore such questions through a close reading of key international legal instruments, doctrines, and decisions, coupled with an introduction to the relevant critical scholarship. The course will aim to familiarize students with the international human rights system and the ways this system interacts with the governance of migration. In the process, we will engage with multiple perspectives on mobility and human rights, and will address the key points of tension in international discussions today. The course will provide ways to engage critically and imaginatively with these issues and consider alternative approaches to the current system.
